1. Scope of Validity (valid from 01/01/2016)

These general terms and conditions of sale (GTC) govern the relationship between the company luxeforyou and its customers. Any divergent agreement requires written form to be valid.

2. Prices and VAT

Our prices are indicated in Swiss Francs (CHF) and include VAT.

The prices available on our site www.luxeforyou.ch are indicative and may be modified at any time. Only the prices guaranteed by a written offer remain valid until the expiration of that offer.

3. Warranty

Unless otherwise indicated for used items, all products sold by luxeforyou are free from manufacturing defects. Moreover, to the knowledge of luxeforyou, these products are not encumbered, declared, stolen, or lost to a third party or an insurance as well as to the official manufacturer, nor subject to a retention of title clause. Before delivery to the buyer, packages are checked to ensure the accuracy of their contents. Unless otherwise stated, the warranty on products extends for one year, with the invoice serving as proof of warranty.

Excluded from the warranty are damages resulting from a modification or repair made by the buyer, or due to wear, force majeure, as well as non-compliance with operating instructions.

4. Internet Purchase

Orders are only accepted through the online store on the website www.luxeforyou.ch and confirmed by email. Orders placed by telephone or letter are not processed. If it is found after confirmation of the order entry that an item is not deliverable, the corresponding order is canceled by luxeforyou. The customer cannot claim any additional entitlements.

5. Pricing

All prices are inclusive of Value Added Tax (VAT), as well as statutory taxes in Swiss Francs. Additional costs such as extra material, packaging, shipping, delivery charges, and surcharges for certain payment methods and services are billed separately. Subject to technical changes, errors, and printing mistakes, luxeforyou has the right to modify prices at any time. The price indicated in the store or published at the time of the order on www.luxeforyou.ch is applicable. Price changes occurring after the confirmation are not considered.

6. Secure Payment on the Site

In all cases, regular payment triggers the dispatch of the merchandise. Orders are payable in advance by prepayment or by credit card without discount.

The order validated by the customer on the website will only be effective when the credit institution has given its agreement. In case of refusal from it, Luxeforyou reserves the right to cancel the order or stop the shipment of the parcel. In such cases, the customer will be contacted by email or phone as quickly as possible.

For products requiring provisioning, the order is executed only against payment of a deposit, either in cash or by transfer.

The balance is to be paid, either cash on delivery or against advance transfer.

In case of cancellation of the order, the deposit paid remains acquired as down payment.

If the order is fully paid and the goods are not deliverable, the customer will be refunded in full.

7. Liability

Claims for damages for impossibility of performance, breach of contract, fault at the conclusion of the contract and for tort against luxeforyou and its agents of execution and completion are entirely excluded. Any liability for indirect and consequential damages resulting from misuse or poor performance is excluded. In particular, the customer cannot claim damages for consequential damages in warranty cases.

8. Data Protection and Data Security

luxeforyou commits to complying with general data protection and data security provisions. The data entered by the client are processed confidentially and used for the execution of the transaction and for advertising purposes.

The transmission of all personal data and credit cards takes place using internationally proven encrypted SSL technology.

9. Final Provisions and Jurisdiction

Our business activities between the customer and luxeforyou are based solely on Swiss law.

In the event of disputes arising from consumer contracts, the court of the domicile or the seat of one of the parties is competent for customer claims. Any situation not stipulated in these general terms and conditions of sale will be governed by Articles 184 and following of the Swiss Code of Obligations.

The legal venue for any dispute is Nyon.

If certain points of these GTC lose their validity, this does not affect the validity of the other provisions.
